  8.         When a computer hacker gets caught, a series of events
  9. takes place that will dramatically change his/her life. The first
  10. thing after the investigation is complete, will be a visit
  11. by federal agents. They will come into the house and seize any
  12. computer or telephone equipment. Often times a year or more will
  13. pass before the hacker is brought to trial to defend himself.
  14.  
  15.         During the wait to go to trial, the federal agents
  16. in charge of the investigation will search the computer for
  17. evidence to help convict the hacker. Sometimes it will take
  18. months for the agents to completely go through the hard drive,
  19. and look at each file. When they are done they will print out
  20. any file that can be used as evidence.

  22.         When a lack of true evidence exists, the prosecuting
  23. attorney will resort to other means to show the hacker's
  24. guilt. Instead of providing logs that show detailed events
  25. that happen, they will provide text files and online magazines
  26. that were found on the hacker's computer. Everything from
  27. Phrack magazine, to text files on making pipe bombs.

  29.         The attorney tells the judge and jurors that those kinds
  30. of files show intent. They go farther by saying that these files
  31. show the person is a hacker, has hacked, is malicious, and should
  32. be found guilty. Simple text files like the one you are reading.
  33. It doesn't matter if the hacker was working on a term paper on
  34. the subject, or just wants to read other people's ideas, those files
  35. supposedly only show guilt.

  37.         The question I ask is this:

  39.         If I own a gun, does that mean I am a murderer?
  40.  
  41.         If I own a knife, does that make me a mugger?
  42.  
  43.         If I own a fishing rod, does that make me someone
  44.         who fishes illegally on other people's land?
  45.  
  46.         If I own a car, does that make me guilty of hit and run?
  47.         Vehicular homicide?
  48.  
  49.         Those may seem extreme, but if I am in court for a parking
  50. ticket, does the fact that I own a car make me anything else? Does
  51. it show my guilt? Of course not.
  52.  
  53.         It seems that computer crime is the only exception to the
  54. rule. Since the law isn't equipped to deal with computer crime,
  55. and train the attorneys, the victims in this case aren't the system
  56. administrators, but the computer enthusiasts.
